A local jail failed to provide medical treatment for our client’s diabetes while he had been jailed on a probation revocation. As a result, our client lapsed into a coma and later died from untreated diabetes. We litigated this case for 9 years. In that time, the trial court dismissed the action twice requiring use to appeal to the Georgia Court of Appeals. On both appeals, the appellate court agreed with our reasoning and reversed the trial court- a very rare event. Evidence demonstrated that the Jail provided substandard medical care to inmates, including our client. The case settled in mediation shortly before trial.

Hit and Run Driver

A hit & run driver struck our client at the intersection of Buford Highway and North Druid Hills Road in Dekalb County (Atlanta) as she was a passenger in a taxi. She was severely injured and suffered fractures to both her hips, pelvis as well as internal injuries. After the collision, the at fault driver locked the doors to his car and ran from the scene. There were no witnesses who could identify him. Approximately ten minutes later he reported the car stolen. The insurance company refused to cover the loss. After two years of litigation, the hit and run driver continued to insist the car was stolen and his insurance company continued its refusal to pay. One week before trial, our investigation uncovered evidence that forced the insurance company to accept responsibility.

A drunk driver (intoxicated) struck and severely injured our client in the Roswell Alpharetta area. Our client suffered leg (“femur fractures”) to both legs. The DUI driver was a North Fulton County school teacher. The investigating officer did not suspect the drunk driver was DUI and did not charge her at the scene. My client was driving alongside a tractor trailer on I-285 in Dekalb County, Georgia. The truck driver made a lane change and side-swiped my client. The impact caused her to lose control and strike the median wall. The insurance defense attorneys aggressively defended the case. They argued that the accident was minor. They claimed there was little damage to my client’s car. A personal injury lawyer with no experience in truck accidents may have settled the case for $50,000.00. In fact, this was the insurance company’s offer- and they adamantly refused to offer more. I looked deeper into the case. I sought to uncover the reason for the accident. I applied my knowledge of the Federal Motor Carrier Safety Regulations. The regulations require trucking companies to train their drivers. The FMCSR’s also require trucking companies to make sure their truck drivers do not exceed their hours of service. The truck driver had exceeded his hours of service and had not been trained. During my investigation, I learned that the trucking company knew the regulations but chose to ignore them. The case settled in mediation for $700,000.00.

My client was a former body builder driving one early morning to LA Fitness in College Park, Georgia. While driving in the right lane, she was sideswiped by a UPS tractor trailer.
